Official Rules
No Purchase Necessary

  1. Sweepstakes Period: The True Love, True Fans Sweepstakes (the "Sweepstakes") starts at 10:00 a.m. Eastern Time ("ET") on January 25, 2023 and ends at 11:59 p.m. ET on February 8, 2023 ("Sweepstakes Period"). Administrator’s clock shall be the official clock of the Sweepstakes. All entries must be received during the Sweepstakes Period to be valid and eligible for the Sweepstakes.

  2. Eligibility: The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older and have a web-enabled mobile device as of date of entry. Employees, officers, and directors of Sterling Jewelers Inc. (“Sponsor”), the National Football League (“NFL”) and its Member Clubs, and NFL Ventures, L.P.,  Renaissance Global LTD, Don Jagoda Associates, Inc. (“Administrator”), and each of their respective parent companies, affiliates, subsidiaries, retailers, advertising and promotion agencies and judging organizations or any entities engaged in the development, distribution, implementation or administration of the Sweepstakes, including third party fulfillment agencies and all local sponsors (collectively with Sponsor and Administrator, the “Sweepstakes Parties”), as well as their immediate family members (spouses, parents, children, siblings, and their spouses) regardless of where they live, and/or persons living under the same household (whether or not related) are not eligible to enter. This Sweepstakes shall be construed and evaluated solely according to United States law and subject to all federal, state and local laws and regulations. Void in Puerto Rico, all United States territories and possessions, and where prohibited.  By entering, entrants acknowledge compliance with these Official Rules, including eligibility requirements. Sponsor and/or Administrator reserves the right to verify eligibility at any time. All entrants must have an Instagram® account in good standing and follow the Sponsor’s Instagram® page to be eligible to enter.

  3. How To Enter: During the Sweepstakes Period, entrants may enter by visiting the KAY Jewelers® Instagram® account. At the start of the Sweepstakes Period, KAY Jewelers® will post a Sweepstakes call-to-action Post (“Instagram Post”). To submit a valid entry into the Sweepstakes, you must: (i) follow @Kayjewelers, (ii) upload one (1) photo depicting how the love for your significant other and your football team has surpassed all others, (iii) in the caption, respond to the prompt in Kay Jewelers® Instagram Post by describing the role of football has played in your relationship, (iv) mention @Kayjewelers and include hashtags: #TrueLoveTrueFans and #Sweepstakes. Response must also abide by this Section 3, including the Entry Guidelines below, to gain one (1) Entry into the sweepstakes. Entries will not be judged. You must have a public Instagram account and, if you are selected as the winner, must be able to receive Direct Messages. By uploading a photo and using the hashtags, you are agreeing to these Official Rules.  Limit one (1) Entry per person. You may only use one (1) Instagram account ID to enter. An entrant must provide all information requested to be eligible to win.

    ENTRY GUIDELINES:
    • Entry must include the required hashtags.
    • Entry must be original and any text contained in Entry must be in English.
    • Entry must not (and entrants represent and warrant that it will not), violate or infringe any third-party copyright, trademark, trade dress, or other proprietary right of any entity or person (living or deceased), including but not limited to rights of privacy, publicity or portrayal in a false light.
    • Entry must not violate any law or regulation.
    • Entry must not include any image and/or likeness of any minor persons.
    • Except for items owned by Sponsor or the NFL, Entry must not reference any commercial/corporate advertising, including but not limited to corporate logos, brand names, slogans, political, or religious statements, or be otherwise objectionable, as determined in Sponsor’s sole discretion.
    • Entry must not include any commercial solicitation or promotional materials, websites, contact information or personally-identifiable information (e.g., first or last name, address, phone number, place of work, email address, etc.).
    • Any Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified and may be deleted.
    • Entry must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
    • Entry cannot defame, misrepresent or contain disparaging remarks about Sponsor, the Released Parties, or their respective products and services, or other people, products or companies.
    • Entry must not contain content that is false, inaccurate, or misleading.
    • Entry must not include references to any activity that Sponsor deems to be, in their sole discretion, lewd or indecent.
    • Any person depicted in the photo must be 18 years or older and must have provided their consent to be depicted in your photo.

By submitting an Entry in this Sweepstakes, entrants hereby grant and irrevocably assign to Sponsor, the exclusive, irrevocable, perpetual, worldwide right, title and interest in and to the Entry, including all rights to reproduce, publish, edit, market, store, adapt, assign, sell, dispose of, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Entry or excerpts of the Entry (as such may be edited and modified by the Sponsor in its discretion), and/or otherwise use the Entry in any manner, form, format, or media now known or hereinafter created, including on the Internet in perpetuity, and for any purpose, including, but not limited to, for editorial, commercial, promotional and all other purposes (including posting on Sponsor-affiliated websites, social channels, and/or other Sponsor-selected media). Entrants hereby disclaim any rights, including any copyright or any other intellectual property right, in or to the Entry following the assignment contemplated hereby.

Entrants acknowledge and agree that submitting an Entry constitutes permission for Sweepstakes Parties to use entrants’, and any other person’s that was depicted in the Entry, name, picture, statements, state of residence, biographical information, and likenesses and Entries for promotional purposes in any and all media throughout the Universe in perpetuity without further compensation, notification, or permission from entrants, except where prohibited by law.

  1. Entry Submission: By entering the Sweepstakes from a mobile device, you may be required to turn on location services on your mobile device. Message and data rates may apply. Entrants must pay normal Internet access and data usage charges that may be imposed by their online or mobile service providers to such providers. Any use of robotic, repetitive, automatic, programmed or similar automated Entries (including, but not limited to, sweepstakes or contest entry services), regardless of method of submission, are prohibited, and any use of such automated Entry methods will cause disqualification. Duplicate or multiple online entries from the same person/Instagram account or the same person using different email addresses/Instagram accounts, identities, registrations, logins, or any other methods per Entry Period are not permitted and will be automatically eliminated from the Sweepstakes. Incomplete, incorrect, corrupted, or untimely entries are void and will be disqualified. All Entries become the property of Sponsor and will not be returned, and Sponsor will not verify receipt of Entries. By submitting an Entry, you warrant and represent that the Entry (i) is your sole, original work, (ii) does not infringe the intellectual property, privacy, publicity, or any other rights of any third party, and (iii) does not violate any law or regulation. Any Entry or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, inappropriate, disparaging, offensive or contains proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the entrant. Entries should not contain any third-party materials (except as owned by Sponsor), or otherwise violate or infringe (or possibly infringe) any copyright, trademark, logo or mark that identifies a brand.

  2. One (1) Grand Prize: Consisting of one (1) two-thousand-dollar ($2,000) KAY gift card and one (1) True Fans necklace of winner’s favorite team (approximate retail value up to six hundred dollars $600) (collectively, the "Grand Prize"). Approximate Retail Value (“ARV”) of Grand Prize: $2,600. All federal, state and local taxes are the sole responsibility of winner. Grand Prize is awarded on an “as-is” basis, are non-transferable and no substitutions are permitted, except by Sponsor, who reserves the right, in its sole discretion, to substitute the Grand Prize (or portion of the Grand Prize) with a prize of equal or greater value, if Grand Prize (or portion of Grand prize), becomes unavailable. No cash redemption of Grand Prize, except at Sponsor’s sole discretion. Gift Card is not redeemable for cash or used as payment for exchanges, purchases of additional gift cards, or as an adjustment to prior purchase(s) or applied as payment on any account, it may not be returned, and will not be replaced if lost or stolen. Gift card may also be subject to additional terms and conditions/expiration date.

  3. Random Drawings and Winner Notification: There will be one (1) random drawing from among all eligible Entries received during the Sweepstakes Period, which will take place on/about February 13, 2023. Drawing will be conducted by the Administrator, an independent judging organization whose decisions are final on all matters relating to this drawing. Odds of winning depend on the total number of eligible Entries received. Potential winner will be contacted by Sponsor via Instagram Direct Message and will be required to provide additional information through email to the Administrator, including his/her name, email, address, date of birth within twenty-four (24) hours of notification. If the potential winner does not respond within twenty-four (24) hours, an alternate winner may be selected and notified via Instagram Direct Message. Potential Grand Prize winner (“winner”) will be mailed their Grand Prize within 6 weeks after verification. Return of Grand Prize or prize notification as undeliverable may result in disqualification and alternate potential winner selection.

  4. General Rules: By participating in this Sweepstakes, each entrant agrees to be bound by these Official Rules and instructions and by all decisions of the Sweepstakes Parties, which are final and legally binding in all matters relating to this Sweepstakes. By participating, entrants and winner agree to release, discharge, indemnify and hold harmless the Sweepstakes Parties and Instagram from and against any claims, damages, or liability due to any damages, or losses or injuries to any person (including death) or property of any kind resulting, in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of Grand Prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes. Entrants further agree not to pursue any right, claim or action against the Sweepstakes Parties and Instagram in connection with their participation in this Sweepstakes. No responsibility is assumed for lost, misdirected or late Entries. In the event of a dispute as to the identity of an entrant, the authorized account holder of the Instagram account used to enter will be deemed to be the entrant. An “authorized account holder” of an Instagram account is the natural person in whose name the Instagram account has been issued by the Internet Access provider for Instagram. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website; violates the Official Rules; or acts in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. By submitting an entry, entrants agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Sponsor on the grounds that any use of the entry infringes any of the entrant’s rights as creator of the entry, including, without limitation, copyrights, trademark rights, and moral rights. Sponsor and its agencies are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability of an individual to participate in or accept the Grand Prize in the Sweepstakes, or by any human error which may occur in the processing of the Entries in this Sweepstakes. Sponsor and its agencies are not responsible for any typographical error in the printing of these Official Rules, administration of the Sweepstakes or in the announcement of the Sweepstakes Grand Prize. Sponsor and its agencies are not responsible for damages to user’s system occasioned by participating in the Sweepstakes or downloading any information to participate in the Sweepstakes. Sponsor reserves the right to modify or cancel any of the portions of the Sweepstakes if they become technically corrupted. In such event, Sponsor would award the Grand Prize from among all eligible Entries received prior to cancellation. Any and all warranties and guarantees are subject to the respective manufacturer’s terms. If by reason of a printing or other error, more prizes are claimed than the number set forth in these rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised Grand Prize. No more than the advertised Grand Prize will be awarded. You further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. You acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

  5. Dispute Resolution: By entering this Sweepstakes, entrants agree that 1) Any and all disputes, claims, and of action arising out of or connected with the Sweepstakes or the Grand Prize shall be resolved individually, without resort to any form of class action; 2) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, and shall not include any punitive, consequential or other damages, including costs associated with entering the Sweepstakes but in no event include attorneys' fees; 3) The value of the Grand Prize as set forth above represents Sponsor’s determinations of the ARV in its sole and absolute discretion thereof and such determinations are final and binding and cannot be appealed. If the actual value of the Grand Prize turns out to be less than the stated ARV, the difference will not be awarded in cash; and 4) Under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All dispute resolution shall be made by the Sponsor in its sole discretion.  These Official Rules shall be governed by, and construed in accordance with the laws of the state of Ohio without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the state of Ohio. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts located in the state of Ohio, and the parties’ consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules.

  6. No Waiver: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

  7. Privacy Policy: Information collected in connection with this Sweepstakes may be used by Sponsor, the Administrator and shared with third parties, in the administration of the Sweepstakes in accordance with these Official Rules and the online Privacy Policy posted at https://www.kay.com/privacy-policy. By participating in the Sweepstakes, Entrants hereby agree to Sponsor’s and/or Administrator’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.

  8. Winner List: For the name of the winner, available after March 1, 2023, for thirty (30) days, send an email to: Winners@dja.com with WINNERS & 11-2705-18 in the subject line. Winner List will be sent after the Grand Prize has been awarded.

  9. Sponsor/Administrator: The Sponsor is Sterling Jewelers Inc., 375 Ghent Road, Akron, OH 44333. The Administrator is Don Jagoda Associates, Inc., 100 Marcus Drive, Melville, NY 11747.

  10. Severability: If any provision of these Official Rules shall be held invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law and the Sponsor’s fundamental intentions hereunder, and the remaining provisions shall not be affected or impaired, provided, however, that in such cases the parties oblige themselves to use their best efforts to achieve the purpose of the invalid provision by a new legally valid stipulation.

  11. Trademark Attribution: The KAY Jewelers®, and INSTAGRAM® trademarks are trademarks of their respective owners.

The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram. Any questions or complaints regarding this Sweepstakes shall be directed to Sterling Jewelers Inc., not Instagram. You understand that you are providing your information to Sterling Jewelers Inc., and not to Instagram.

NFL Ventures, L.P., the NFL, its Member Clubs and each of their respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in this sweepstakes or any prize awarded. NFL Ventures, L.P., the NFL, and its affiliates or Member Clubs have not offered or sponsored this sweepstakes in any way.
